What are Gilmer County Public Records?

Gilmer County public records are documents generated by officials or personnel working in government agencies. According to Section 50-18-70 of the Open Records Act, these records refer to all forms of written or oral documentation, including papers, letters, maps, books, audios, photographs, computer-generated information, audio visuals, data fields, and other materials.

In Gilmer County, public records are open to the residents and may be inspected or copied during an agency's working hours. However, the law exempts access to some records. Some exceptions to the Georgia Open Records Act include:

  • Military discharge records (for instance, DD 214 records) submitted to the county commissioners or the county clerk in compliance with Section 15-6-72 of the Official Code of Georgia Annotated (O.C.G.A)
  • Juvenile records (O.C.G.A. § 15-11-708)
  • Hospital peer review records (O.C.G.A. § 31-7-15(d); O.C.G.A. § 31-7-133(a))
  • Pardons and parole board records (O.C.G.A. § 42-9-53b)
  • Records received from an insurance company investigating a fire loss of real or personal property (O.C.G.A. § 25-2-33d)
  • Personal identifying information on driver's licenses
  • Records gathered for law enforcement or prosecution purposes that may endanger the life of a confidential source or threaten the safety of the individuals involved
  • Georgia Uniform Motor Vehicle Accident Reports (unless the requester tenders a written statement of need to the county clerk)
  • Investigative reports marked as classified by the Department of Corrections and intelligence reports from Internal Affairs (O.C.G.A. § 42-5-36(b))
  • Crime scene photos portraying death and dismemberment of bodies; images from autopsies and coroner's reports (O.C.G.A. § 45-16-27(d),(e)(2))
  • Records that reveal an individual's social security number, mother's birth name, credit card information, debit card information, bank account information, utility account numbers, and other sensitive details
  • Other records deemed confidential by federal statute or state regulation

In addition to government agencies, some public records may also be accessible from third-party websites. These non-government platforms come with intuitive tools that allow for expansive searches. Record seekers may either opt to use these tools to search for a specific record or multiple records. However, users will need to provide enough information to assist with the search such as:

  • The name of the subject involved in the record (subject must be older than 18 or not juvenile)
  • The address of the requestor
  • A case number or file number (if known)
  • The location of the document or person involved
  • The last known or current address of the registrant

Third-party sites are not sponsored by government agencies. Because of this, record availability and results may vary.
